BlueStream Entertainment Terms of Use

1. Introduction

Welcome to Bluestream Entertainment ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of our website, www.bluestreamentertainment.ca, and the services we provide, including DJ services, photo booth rentals, event lighting, and other entertainment services (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Acceptance of Terms

By accessing or using our Services, you represent and warrant that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction
• You have the legal capacity to enter into a binding agreement
• You agree to comply with these Terms

If you are using our Services on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" and "your" in these Terms refers to both you individually and that entity.

3. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of our Services after the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

If we make material changes to these Terms, we will make reasonable efforts to notify you, such as by posting a notice on our website or sending you an email if we have your contact information.

4. Access and Use of Services

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use.

4.2 Prohibited Activities

You agree not to:

• Use our Services in any way that violates any applicable law or regulation
• Use our Services for any illegal or unauthorized purpose

4.3 Service Availability

We strive to ensure that our Services are available at all times. However, we do not guarantee that our Services will be available at all times or that access will be uninterrupted or error-free. We reserve the right to suspend, restrict, or terminate access to our Services at any time without notice for maintenance, updates, or other reasons.

5. Account Registration

Some features of our Services may require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your account credentials confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account or any other breach of security

We reserve the right to suspend or terminate your account if we suspect that any information you provide is inaccurate, outdated, or incomplete, or if you have violated these Terms.

6. Bookings and Payments

6.1 Service Bookings

When you book our Services, you agree to provide accurate and complete information about your event, including the date, time, location, and specific requirements. We will confirm the availability of our Services for your event and provide you with a quote based on the information you provide.

A booking is not confirmed until:

• You have received a written confirmation from us
• You have signed our service agreement
• You have paid the required deposit

6.2 Payments

Payment terms are as follows:

• A non-refundable deposit (typically 25% of the total fee) is required to secure your booking
• The remaining balance is due 14 days before the event date
• For bookings made less than 14 days before the event, full payment is required at the time of booking

We accept payments via credit card, e-transfer, or other methods specified in your service agreement. All payments are processed securely through our payment processors.

6.3 Pricing

Prices for our Services are as quoted on our website or in your service agreement. We reserve the right to change our prices at any time, but such changes will not affect bookings that have already been confirmed.

Additional charges may apply for:

• Extended service hours beyond the agreed time
• Additional equipment or services requested on the day of the event
• Travel expenses for events outside our standard service area
• Special requests or customizations

7. Cancellation and Refund Policy

7.1 Cancellation by You

If you need to cancel a confirmed booking, the following terms apply:

• More than 90 days before the event: Deposit is non-refundable, but may be transferred to a future event within 12 months
• 60-90 days before the event: 50% of the total fee is payable
• 30-59 days before the event: 75% of the total fee is payable
• Less than 30 days before the event: 100% of the total fee is payable

All cancellations must be made in writing (email is acceptable).

7.2 Rescheduling

If you need to reschedule your event, we will make reasonable efforts to accommodate the new date, subject to our availability. Rescheduling fees may apply as follows:

• More than 60 days before the event: No fee
• 30-60 days before the event: 10% of the total fee
• Less than 30 days before the event: 25% of the total fee

If we are unable to accommodate the new date, our cancellation policy will apply.

7.3 Cancellation by Us

In the rare event that we need to cancel a booking due to unforeseen circumstances (such as illness, equipment failure, or force majeure events), we will:

• Make reasonable efforts to find a suitable replacement service provider
• If no replacement can be found, provide a full refund of all payments made

Our liability for cancellation is limited to the refund of payments received.

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is our property or the property of our licensors and is protected by Canadian and international copyright laws.

Our trademarks, service marks, and trade names may not be used without our prior written permission.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and view the content on our website for personal, non-commercial use only. You may not:

• Reproduce, duplicate, copy, sell, resell, or exploit any portion of our website
• Use our trademarks, logos, or service marks without our prior written consent
• Remove any copyright, trademark, or other proprietary notices from any content

8.3 Event Photography and Recordings

We may take photographs or make recordings at events where our Services are provided. By booking our Services, you grant us permission to:

• Take photographs and make recordings at your event
• Use such photographs and recordings for promotional purposes, including on our website, social media, and marketing materials

If you do not wish for photographs or recordings to be taken at your event, you must notify us in writing before the event.

9. User-Generated Content

If you submit, upload, or share any content through our Services (such as reviews, testimonials, or feedback), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that:

• You own or control all rights to the content you submit
• The content is accurate and not misleading
• The content does not violate these Terms or any applicable law
• The content will not cause injury to any person or entity

We have the right, but not the obligation, to monitor, edit, or remove any content submitted to our Services.

10. Disclaimers

Our Services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of our Services or the information, content, materials, or products included on our website.

To the full extent permissible by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that:

• Our Services will meet your specific requirements
• Our Services will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of our Services will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained through our Services will meet your expectations

11. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:

• The use or inability to use our Services
• Unauthorized access to or alteration of your transmissions or data
• Statements or conduct of any third party on our Services
• Any other matter relating to our Services

In no event shall our total liability to you for all damages, losses, or causes of action exceed the amount you have paid to us for the Services or Call for Pricing whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Bluestream Entertainment, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from:

• Your violation of these Terms
• Your violation of any rights of any other person or entity
• Your use or misuse of our Services

13. Governing Law

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or our Services shall be resolved through the following process:

1. Informal Resolution: We encourage you to contact us first to seek an informal resolution of any dispute.
2. Mediation: If the dispute cannot be resolved informally, either party may initiate mediation by a neutral mediator mutually agreed upon by the parties.
3. Arbitration: If mediation is unsuccessful, the dispute shall be settled by binding arbitration in accordance with the rules of the Canadian Arbitration Association.
4. Venue: Any arbitration shall take place in Alberta, Canada, unless otherwise agreed upon by the parties.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Services.
